Contentious Probate is a dispute relating to the administration of a deceased’s persons estate. This could include a dispute between Executors and/or Beneficiaries, a dispute over the interpretation of a Will, or a dispute over the value of estate assets.
Dealing with the death of a loved one is never easy and the administration of an estate can be very complex and lengthy. It is possible that you may feel that a loved one’s estate Is not being managed properly and you may want to consider contesting the Will.
Certain categories of people may be able to make an application to the Court to claim under the Inheritance (Provision for Family and Dependants) Act 1975 for reasonable financial provision.
The law sets out the requirements for a Will to be valid. If there is a question as to whether the Will was made in accordance with the law then it may be contested. There must be grounds and evidence to support such a claim.
